Terms of Use

Acceptance of terms

By creating an account or using any part of the TestVibe platform, you confirm that you are at least 16 years old, have the legal capacity to enter into a binding agreement, and accept these Terms of Use on behalf of yourself or the organisation you represent.

Use of the service

TestVibe grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for your internal testing and development purposes, in accordance with these terms.

The service is provided during an early-access period. Features, pricing, and availability may change. We will notify registered users of material changes in advance where reasonably possible.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at security@testvibe.com if you suspect any unauthorised access.

You may not share access credentials, create accounts on behalf of others without their consent, or use automated methods to create accounts.

Intellectual property

TestVibe and all associated software, designs, trademarks, and content are the property of Ice Tea Group or its licensors, protected by copyright, trademark, and other intellectual property laws.

Nothing in these terms grants you any right to use the TestVibe name, logo, or other brand elements without our prior written consent.

Your content

You retain ownership of any test scenarios, feature files, scripts, and other content you create using TestVibe ("Your Content"). By using the service you grant Ice Tea Group a limited licence to process, store, and transmit Your Content solely to provide the service to you.

You are responsible for ensuring Your Content does not violate any applicable law or third-party rights. We do not review user content and are not responsible for it.

Prohibited conduct

You may not use TestVibe to:

• Test systems or applications you do not own or have explicit written permission to test.
• Conduct load tests or automated requests against third-party services without their consent.
• Attempt to circumvent security controls, access other users' data, or reverse-engineer the platform.
• Distribute malware, spam, or otherwise harmful content.
• Resell or sublicence access to the service without our written permission.
• Violate any applicable local, national, or international law or regulation.

Violation of these restrictions may result in immediate termination of your account.

Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or free from harmful components. Use of the service is at your own risk.

Limitation of liability

To the maximum extent permitted by applicable law, Ice Tea Group and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business — arising out of or related to your use of the service.

Our total liability to you for any claim arising out of or related to these terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $100 if you have not made any payments.

Termination

You may stop using the service at any time by deleting your account. We may suspend or terminate your access at any time if we reasonably believe you have violated these terms, with or without notice.

Upon termination, your right to use the service ceases immediately. Sections on intellectual property, disclaimer, limitation of liability, and governing law survive termination.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising under these terms shall be resolved in the courts of Delaware, and you consent to the personal jurisdiction of those courts.

If you are an EU consumer, you may also have the right to bring proceedings in the courts of your country of residence.

Changes to these terms

We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, notify you by email or in-app notice at least 14 days before the change takes effect.

Your continued use of the service after changes take effect constitutes your acceptance of the revised terms.
